Terms of Sale
These terms are applicable to artists, photographers and rights owners of images, artistic works or any material that is subject to Intellectual Property Rights of any sort.
These Terms of Sale are hereby entered into between you (by uploading any image on the website) and/or by clicking on the accept button, and Sowar On Line (“SOL”) on the date you upload the photo or agree to those terms in any other way.
By accepting the below terms and conditions you declare having read the below terms, the License Agreement which shall be accepted by buyers of the Images on which you should be agreeing for your Proprietary material shall be sold; you further declare that any liability may be set upon you by virtue of these terms are acceptable and doable by yourself while warranting that you are aware of nothing that may hinder your commitments under these terms.
- You agree that by uploading your Image (material) you grant a non-expiring, non-repudiating License to SOL to display, resell, promote, manage, archive the Image and sublicense all or part of this license to its trusted suppliers in relation to hosting, archiving or managing the website and sublicense it to its users in relation to the viewing, selecting and downloading of the Images.
- You further declare and warrant that you are the sole owner of all rights conferred in the material you upload and that you have not sold, licensed or given any other party any right whatsoever on the material/image you upload; in this regard, you agree to hold harmless SOL from and against any claim that may be brought by any person in relation to any rights on the Image or material you provided.
- The Commercial terms of this transaction are:
- Once an Image is uploaded with you acceptance, the website administration team will be screen the Image for quality assurance and will determine the section in which the Image is believed fitting the most.
- The Image will be priced on two methods (Exclusive and Non-Exclusive). For each price, the buyer will agree to the terms of the License Agreement and the price and shall pay for the price in one of the methods of payment indicated by the website. If you have reasons to believe that any image you upload can not be sold on Exclusive basis, please indicate so in the registration screen. For this purpose, you agree that the pricing of the Image/material will be in the sole discretion of SOL and that SOL may, from time to time and as the need be, make promotional campaigns that may include lower prices or bundled images to promote the website or particular images.
- Once payment is received (through SOL bank confirmation that funds are deposited therein), you will be entitled to 40% of the price agreed for the particular method chosen and paid for by the buyer.
- You will be receiving a confirmation of sale on your e-mail (which you should be providing in the registration screen); then once the funds are deposited in SOL bank account, you will receive another confirmation of availability of funds in which you will be asked to provide your bank account details. Thereafter, SOL will be transferring your funds (within maximum of 30 calendar days) to your designated bank account.
- You will receive a final confirmation of the transfer taking place with the confirmation number to allow you to follow up the payment at your designated bank.
- If you require a payment notification in writing or electronically please indicate so in the notes section in the registration.
In the events of charge back being made against SOL after a buyer has paid for the Image, you will be notified as soon as possible with the details of the charge back request taking place. If this takes place after your payment has been issued, you will be asked to refund such amount to SOL. Otherwise, you will be in custody of amounts in violation of the Law and this will be considered as act of theft that may trigger legal action on the part of SOL.
For the purpose of this agreement:
If your image/material is sold on Exclusive basis you understand that this will mean that neither you nor any other person shall have the right to use the material/image once the payment is made for such exclusive sale.
